Jury: Death penalty for Oakland double murderer

Associated Press - November 24, 2009 1:24 PM ET

OAKLAND, Calif. (AP) - An Alameda County jury has decided that a drug dealer convicted of 2 Oakland murders in 2001 should be executed.

After two days of deliberations, the jury decided Monday that Christopher Evans should be given the lethal injection for fatally shooting two people at a hair salon in revenge for being punched in the face.

Evans was convicted in July of first-degree murder in the killing of 28-year-old Tina Marie Rose and second-degree murder in the killing of 41-year-old Tommy Lee Brown. Rose was the sister of a man who punched Evans, and Brown had tried to stop Evans before he shot Rose.

Evans' defense attorneys argued that death is too harsh a penalty for Evans, who hadn't previously been convicted of serious violent crimes.

Sentencing is scheduled for Feb. 3.
