
GILROY, Calif. - After an emotional public discussion, the Gilroy City Council voted 4 to 3 to proceed with stopping medicinal marijuana shop, Medileaf.
Medileaf said it plans to appeal and remain open during the appeal process. The city council said Medileaf was operating illegally without a business license. It also said the shop was in violation of federal law, the Gilroy city code and the city's zoning ordinance.
The Council ordered a cease and desist order last week after Medileaf opened up shop earlier in the week. Medileaf's owners said in a statement on its website, that their attorneys had advised them that they would be fine opening up shop, since the operation was structured as a non-profit.
After a lengthy council meeting Tuesday night, four of the three city council members voted in favor of ordering the city attorney to take all necessary actions to enjoin medical marijuana dispensary activities by Medileaf and its affiliates.
Councilmembers against the decision said they feared continuing to challenge the issue could end up costing the city of Gilroy millions of dollars during a potentially lengthy litigation process.
